Terms of Use.

The terms under which evindex.ca is provided, what is and isn’t permitted, and how liability is allocated.

1. Acceptance and eligibility

By accessing or using evindex.ca (the “Site”), you agree to these Terms of Use. If you do not agree, do not use the Site. Your continued use of the Site on or after the “Last updated” date set out at the top of these Terms constitutes your acceptance of the version then in effect.

You must be at least 18 years old, or the age of majority in your province or territory of residence, to agree to these Terms. If you are under that age, your parent or legal guardian must read these Terms and supervise your use of the Site. By permitting your use of the Site, your parent or legal guardian agrees to be responsible for your compliance with these Terms and for any liability arising from your use of the Site.

2. Description of service

EV Index aggregates and displays publicly available data about electric-vehicle adoption and ownership economics in Ontario, including registration counts published by the Ontario Ministry of Transportation, census demographics published by Statistics Canada, public charging-station data published by Natural Resources Canada, vehicle fuel-economy ratings, electricity and gasoline price series, and maintenance and emissions reference data from the third-party sources identified in Section 3. The Site also provides interactive calculators (each, and together, the “Calculator”): a savings calculator that, on the basis of values you enter and the reference data described in Section 3, computes illustrative estimates of the annual, three-year and five-year cost difference between operating a representative gasoline vehicle and a representative electric vehicle in Ontario, together with an estimated annual quantity of avoided CO2-equivalent emissions; and an Ontario charging-cost tool that estimates the monthly cost of charging an electric vehicle on home and public electricity rate plans (collectively, the “Calculator Outputs”). The Calculator Outputs are general informational estimates only. They are not a quote, an offer, a price, a rate, a guarantee of savings, financial, tax, legal, engineering, energy, automotive or environmental advice, a recommendation to purchase, finance, lease, insure, or dispose of any vehicle, or a representation that any third-party vehicle, charging product or service will perform as modelled. The Calculator Outputs depend on assumptions, default values, third-party reference data, and the inputs you supply, each of which may be incomplete, out of date, or unrepresentative of your circumstances. The Site is provided for general informational purposes only. It is not a substitute for current data published directly by the originating authorities, for professional advice, or for personal judgment about vehicle purchases, charging infrastructure, or any other matter.

2A. Product reviews, recommendations, and electrical safety

EV Index publishes editorial product reviews and buying guides covering consumer products (including, without limitation, Level 2 electric-vehicle home chargers). The picks, rankings, and accompanying commentary in any such review or guide reflect the editorial judgment of EV Index based on publicly available specifications, manufacturer documentation, retailer listings, and independent expert reviews, and are provided for general informational purposes only.

Specifications, prices, warranty terms, certifications, and similar product attributes displayed in any review, comparison, or buying guide are reproduced in good faith from manufacturer documentation, retailer listings, or other publicly available sources at or about the date the page was last updated. They may be incomplete, out of date, or superseded by the manufacturer or retailer at any time. You must verify any such attribute directly with the manufacturer or retailer before you make a purchase or installation decision.

Product reviews and buying guides on the Site are not, and must not be relied on as, engineering, electrical, safety, fire-protection, insurance, financial, or legal advice, or as a recommendation that any specific product is suitable for your home, vehicle, panel, or installation conditions. In Ontario, electrical installation work for hire must be performed by a Licensed Electrical Contractor and inspected by the Electrical Safety Authority under Ontario Regulation 164/99. You are solely responsible for engaging qualified professionals, obtaining required permits and inspections, and verifying that any selected product is compatible with your vehicle, electrical service, and intended installation location. EV Index is not responsible for any installation, equipment, property, vehicle, personal, or other loss arising from any decision made in reliance on a product review or buying guide on the Site.

3. Data sources and accuracy

The data displayed on the Site is sourced from third-party government datasets, including:

Ontario Ministry of Transportation (MTO) — the quarterly “Electric Vehicles in Ontario by FSA” dataset published on data.ontario.ca.
Statistics Canada— 2021 Census Profile (at the Census Subdivision and Forward Sortation Area levels) and table 18-10-0001 (monthly retail gasoline prices by census metropolitan area).
Natural Resources Canada (NRCan) — the public charger registry (used both for active-station counts and for per-station price aggregation) and the Fuel Consumption Ratings published on the Open Government Portal.
Ontario Energy Board (OEB)— published Regulated Price Plan schedules (time-of-use, Ultra-Low Overnight, and Tiered).
Argonne National Laboratory (US Department of Energy) — the AFLEET 2024 vehicle-cost tool, used for maintenance reference values.
Toronto Atmospheric Fund— the 2024 GTHA Carbon Emissions Inventory, used as the source for Ontario’s grid-carbon intensity (which itself cites the IESO Annual Planning Outlook).
Environment and Climate Change Canada (ECCC) — National Inventory Report, used for the gasoline emission factor.
Other municipal, regional, and provincial datasets as coverage expands.

This data is provided by government agencies and is reproduced by EV Index as a public convenience. We do not register vehicles, generate registration counts, install or operate charging stations, or independently verify the data.

Data may be:

Delayed— there is a lag between a quarter closing and the data appearing in government feeds, which may be further delayed before appearing on the Site.
Incomplete— not all registrations, postal areas, or stations may be captured in any given release.
Inaccurate— errors, corrections, or data-quality issues may exist in the source data, including misclassifications, suppression of small counts, or rounding.
Out of date— the current count or status of any postal area, city, or charging station may differ from what is displayed.

You must verify current information directly with the relevant authority before making any decision. EV Index is not responsible for purchasing, business, employment, investment, insurance, or any other decision made in reliance on information displayed on the Site.

By accessing the Site, you acknowledge these limitations and assume all risk arising from your use of, or reliance on, the information displayed. EV Index does not represent or warrant that any data point, count, ranking, growth figure, doubling-time estimate, or other derived metric is correct, current, or fit for any particular purpose. Derived metrics are calculated from the public source data and inherit any limitation of that source data.

Incentive and rebate information. Where the Site describes government or utility electric-vehicle incentives, rebates, or funding programs, it does so for general information only and is not a guarantee that you will qualify for, or receive, any program, amount, or rebate. Program amounts, eligibility criteria, application processes, and availability are set and administered by the relevant government body or program administrator, change without notice, and may close or run out of funding. Listed amounts are maximums, not the amount any given applicant will receive. None of this is financial, tax, or legal advice. You must confirm current eligibility and amounts directly with the official program before relying on anything shown on the Site.

3A. Calculator accuracy, reliance, and your inputs

3A.1 Estimates only. The Calculator Outputs are estimates derived by applying simple arithmetic to (a) reference values described in Section 3 and (b) inputs you supply. They are not, and must not be relied upon as, a quote, a binding figure, an opinion of fitness, or a substitute for a quotation from a vehicle vendor, lessor, financier, insurer, electricity retailer, or charging-network operator.

3A.2 Refresh lag and staleness.Reference values used by the Calculator — including (without limitation) the Ontario Energy Board Regulated Price Plan rates (time-of-use, Ultra-Low Overnight and Tiered), the Statistics Canada 18-10-0001 retail gasoline series, the Natural Resources Canada Fuel Consumption Ratings, the Natural Resources Canada public-charging price data, the Argonne National Laboratory AFLEET maintenance base values and year-N curve, the USD-to-CAD conversion factor applied to AFLEET, and the Ontario grid carbon-intensity figure — are refreshed on the cadences described on the methodology page and may at any time lag the figure currently in effect or in publication. EV Index does not represent that any reference value used in any Calculator Output is the value in effect on the date you use the Calculator.

3A.3 Your inputs and overrides. Where you enter a value or override a default in the Calculator (including vehicle fuel economy, electricity consumption, kilometres driven, charging mode, rate plan, gas price, electricity rate, or maintenance cost), you are solely responsible for the accuracy of that value, including its unit of measurement and decimal placement. The Calculator does not validate the realism of any input you provide.

3A.4 No reliance, assumption of risk. You acknowledge that EV Index does not know your particular circumstances and that any decision to acquire, finance, lease, insure or dispose of a vehicle, to enter into a charging-network arrangement, or to take any other commercial or financial step in reliance on a Calculator Output is a decision you make on your own assessment. You assume all risk arising from any reliance on the Calculator Outputs. You agree that any “special relationship” between you and EV Index in respect of the Calculator is negated by this paragraph to the maximum extent permitted by law, and that EV Index has not assumed responsibility for the accuracy of any Calculator Output as against any particular decision you may take.

3A.5 No endorsement or inducement. Display of a Calculator Output beside, before or after any advertisement, affiliate link, manufacturer reference, or third-party content does not constitute a representation that a particular vehicle, charger, retailer, or service will yield that Calculator Output, and does not constitute an inducement to enter into any contract with any such third party.

3A.6 Whole-home estimates, plan comparisons, and assumed usage profiles. Certain Calculator tools estimate the electricity cost of your entire household, not only of charging a vehicle, and rank or label one rate plan as cheaper than another. Those outputs cover electricity (energy) charges only and exclude delivery, regulatory charges, and applicable taxes net of the Ontario Electricity Rebate. Where you do not enter your own figures, the Calculator allocates household usage across price periods using a default usage profile published by the Ontario Energy Board, which is a general assumption that may not reflect your home. Any plan identified as cheapest is cheapest only on the rates, usage, and assumptions then entered, is not a recommendation to adopt or switch plans, and is not advice that any plan is suitable for you. You are responsible for confirming your rate plan, usage, and the current regulated rates directly with the Ontario Energy Board or your utility.

4. Open data acknowledgment

All EV registration, census, and charging-station data displayed on the Site is reproduced from publicly available open-data feeds published by Canadian government agencies. Each agency publishes its data under its own open data licence or terms of use, including (without limitation):

Ontario Ministry of Transportation — published on data.ontario.ca under the Open Government Licence – Ontario.
Statistics Canada— 2021 Census Profile published under the Statistics Canada Open Licence.
Natural Resources Canada — public charging-station registry and Fuel Consumption Ratings published under the Open Government Licence – Canada.
Environment and Climate Change Canada — National Inventory Report published under the Open Government Licence – Canada.
Ontario Energy Board— Regulated Price Plan rate schedules are published as regulated public utility tariffs; figures are reproduced for informational reference.
Argonne National Laboratory (US Department of Energy) — the AFLEET 2024 vehicle-cost tool is a US federal government work, generally in the public domain in the United States under 17 U.S.C. § 105, and is distributed without restriction for educational and research purposes.
Toronto Atmospheric Fund— the 2024 GTHA Carbon Emissions Inventory is published by a non-profit foundation as a public resource; figures are reproduced with attribution and a link to the source. If the rights-holder considers the use inconsistent with the source’s terms, see the contact path below.
Additional municipal, regional, and provincial agencies under their respective open data licences as coverage expands.

Government-sourced data remains the property of the originating agencies and is reproduced in accordance with each agency’s licence. EV Index makes a good-faith effort to provide attribution as required by each licence. If you are a rights-holder or originating authority and believe the attribution provided is insufficient, please contact us at contact@evindex.ca and we will aim to respond promptly.

5. Corrections, republication of public records, IP complaints

If you believe a figure, ranking, attribution, or other piece of information displayed on the Site is inaccurate, please contact us. Include:

The page URL where the information appears.
The specific value or statement you believe is wrong.
What you believe the correct value is, and the basis for that belief (ideally a reference to the originating authority’s current published record).

Send correction requests to contact@evindex.ca. We aim to acknowledge receipt within 10 business days and to investigate and respond within 30 business days, where reasonably practicable.

Because the underlying data is sourced from government authorities, we may not be able to change a value that accurately reflects the source. Where the source data itself is incorrect, we will direct you to the originating authority, which is the authoritative record-holder, and we will update the Site once the source is corrected.

Republication of public records.EV Index acts solely as a good-faith aggregator and republisher of publicly available open-data records produced by Canadian government agencies. We make no independent factual or evaluative claims about any individual, household, or vehicle; the registration counts, census figures, charging-station records, and other displayed details are reproduced from the originating agency’s published records, with only such aggregation, normalization, spatial alignment, and presentation adjustments as are necessary to display them on the Site. The originating agency is and remains the authoritative record-holder. EV Index retains the discretion, but no obligation, to update, correct, redact, suppress, or remove any content at any time, with or without notice.

In republishing public-record open data in this manner, EV Index relies on the public-interest reproduction provisions of the applicable open-data licences and on the legal protections available under Canadian law for good-faith republication of records made publicly available by government authorities.

Copyright and other intellectual-property complaints. If you believe content on the Site infringes a copyright or other intellectual-property right, please contact us at contact@evindex.ca with sufficient detail to identify the work, the page or URL on the Site, and the rights claimed. We will review such notices in accordance with the Copyright Act (Canada), including the Notice and Notice regime in section 41.25 where applicable, and respond as appropriate.

6. Permitted use

The Site is provided for personal, non-commercial informational use. You may:

Browse and share individual EV Index pages.
Link to evindex.ca.

You may not:

Scrape, crawl, or bulk-download data from the Site using automated means. This restriction does not apply to well-behaved search engine and accessibility crawlers indexing the Site for organic web search results that respect the Site’s robots.txt and rate-limit their requests. The exception in the preceding sentence does not extend to crawlers, bots, or other automated agents that collect content for use in training, testing, fine-tuning, or augmenting machine-learning or artificial-intelligence models or datasets, regardless of their robots.txt compliance.
Use the Site or its data for commercial data products or services without a written licence from EV Index.
Republish or redistribute the underlying data in a way that misrepresents its source, accuracy, or timeliness, or that strips the open-data licence attribution required by the originating authority.
Use any portion of the Site, its content, or its derivative metrics to train, test, fine-tune, or otherwise develop machine-learning or artificial- intelligence models or datasets, or to populate any commercial database, without prior written permission from EV Index.
Interfere with, disrupt, or attempt to gain unauthorized access to the Site or its infrastructure.

Nothing in this Section is intended to restrict fair-dealing use of the Site or its content for the purposes of journalism, criticism, review, education, research, parody, or satire as permitted under the Copyright Act (Canada), provided such use complies with the open data licences under which the underlying data is published, identifies EV Index as the source where appropriate, and does not involve bulk extraction or automated scraping otherwise prohibited above.

Scope of these restrictions.The restrictions in this Section apply to the Site as published by EV Index — including its design, editorial content, derived metrics, presentation, and compilation. They do not, and cannot, restrict the underlying public datasets themselves, which remain available from the originating government authorities under the open data licences identified in Section 4 and may be obtained and used by you directly from those authorities on the terms they set.

7. Intellectual property

The Site design, branding, code, and editorial content of evindex.ca are owned by EV Index. Government-sourced data remains the property of the originating agencies and is reproduced under their respective open data licences. Derived metrics computed by EV Index from public data (such as adoption percentages, growth rates, and doubling-time estimates) are presented for informational purposes and remain subject to the limitations described in these Terms. Nothing in these Terms transfers ownership of any intellectual property to you.

Third-party trademarks and product names. Trademarks, brand names, model names, and the names of independent publications referenced on the Site are the property of their respective owners. References on the Site are for purposes of identification, comparison, and review only and constitute nominative fair use. No affiliation with, sponsorship by, or endorsement from any trademark owner is claimed or implied.

8. Third-party links, advertising, and affiliate relationships

The Site may contain links to third-party websites and services, including manufacturer pages, dealer sites, charging-network apps, and other resources. Some of these may be affiliate links— if you click such a link and complete a qualifying action (for example, a purchase, sign-up, or booking), EV Index may receive a commission at no additional cost to you. Affiliate relationships do not influence which data, rankings, or editorial content are shown on the Site. The specific affiliate programs in use may change over time, and the presence of an affiliate link is not an endorsement of the underlying product, service, or vendor. EV Index is not responsible for the content, availability, practices, or privacy policies of third-party sites.

Amazon Associates Program.EV Index is a participant in the Amazon Associates Program. As an Amazon Associate, EV Index earns from qualifying purchases. Where you click an affiliate link on the Site to Amazon.ca or an affiliated Amazon site, Amazon receives information about that click (including the referring URL and the EV Index Amazon Associates tracking identifier) and processes it under Amazon’s own privacy policy. EV Index receives aggregate commission reporting only.

Third-party advertising.The Site displays third-party advertising, including programmatic display advertising served by Google AdSense and similar networks. Advertisers and ad networks operate independently of EV Index, and the appearance of an advertisement on any page of the Site does not constitute EV Index’s endorsement of the advertiser, its products, or its services, and does not imply any relationship between the advertiser and any data point, postal area, city, or charging station displayed on the same page. EV Index does not control which advertisements appear adjacent to any particular listing or chart. EV Index is not responsible for the content, accuracy, legality, or practices of any advertisement or advertiser. Advertisers do not pay for, and cannot influence, the underlying data, derived metrics, rankings, or any editorial display on the Site.

9. Disclaimer of warranties

The Site, including all content, data, derived metrics, Calculator Outputs, default and reference values used by the Calculator, and functionality, is provided “as is” and “as available”, with all faults and without warranties or representations of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by applicable law, EV Index disclaims all warranties, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy, completeness, currency, reliability, title, quiet enjoyment, and non-infringement.

Without limiting the generality of the foregoing, EV Index makes no warranty, representation, or guarantee that:

any postal area, city, or charging station listed on the Site is correctly identified, is currently in operation, or has the attributes shown;
EV registration counts, growth rates, doubling-time estimates, charger counts, census figures, rankings, or any other displayed details are accurate, complete, current, free of error, or correctly attributed;
any Calculator Output — including any annual, three-year or five-year savings estimate, any avoided-CO2 estimate, any blended electricity rate, any maintenance projection, or any reference value displayed alongside such an estimate — corresponds to the actual cost difference, emissions difference, electricity rate, gasoline price, or maintenance cost that you, any particular vehicle, or any particular charging arrangement will in fact experience;
any decision based on data displayed on the Site (including a vehicle purchase, sale, lease, business investment, employment, or insurance decision) will produce a particular outcome;
the Site, its servers, or any communications transmitted through the Site are free of viruses, malware, or other harmful components, or will be uninterrupted, secure, available, or error-free.

No advice or information, whether oral or written, obtained from EV Index or through the Site creates any warranty not expressly stated in these Terms. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you to the extent prohibited by law.

10. Limitation of liability

To the fullest extent permitted by applicable law, EV Index shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, loss of data, loss of goodwill, or business interruption — arising out of or in connection with:

Your access to or use of, or inability to access or use, the Site.
Errors, inaccuracies, delays, or omissions in the data displayed or in any metric derived from it.
Any Calculator Output, any default or reference value used by the Calculator, any input or override you provide to the Calculator, any difference between a Calculator Output and the actual cost or emissions outcome you experience, and any decision (including any vehicle purchase, financing, lease, charging-network, insurance, or business decision) made in reliance on a Calculator Output.
Any decision made or action taken in reliance on information displayed on the Site, including vehicle purchases, business decisions, investment decisions, or insurance decisions.
Misidentification of any postal area, city, or charging station, or misattribution of any data point.
Any third-party content, links, advertising, affiliate offers, or services accessible through the Site.

To the fullest extent permitted by applicable law, the aggregate total liability of EV Index to you, arising out of or relating to the Site or these Terms (including, for greater certainty, your access to or use of the Calculator and any reliance on any Calculator Output), whether in contract, tort (including negligence), statute, or otherwise, and regardless of the number of claims or the cause of action, shall not exceed CAD $500.

Carve-outs.Nothing in this Section limits or excludes EV Index’s liability for fraud, fraudulent misrepresentation, wilful misconduct, or gross negligence, or for any other matter that cannot be limited or excluded under applicable law. The exclusions and the cap above apply to claims of ordinary negligence, breach of contract, breach of statute, and other matters where limitation is permitted.

Class-action waiver. To the maximum extent permitted by law, you and EV Index each agree that any claim or dispute relating to the Site or these Terms will be brought in an individual capacity only, and not as a plaintiff or class member in any purported class, consolidated, collective, or representative proceeding. This paragraph does not apply to the extent it is unenforceable against consumers under the Ontario Consumer Protection Act, 2002, the Québec Consumer Protection Act, or any other applicable consumer-protection legislation; in particular, if you are a consumer in a jurisdiction whose law preserves your right to participate in a class proceeding, nothing in this paragraph waives that right. If a court of competent jurisdiction finds this paragraph unenforceable in a particular dispute, this paragraph shall be severed as to that dispute only and the remainder of these Terms shall continue to apply.

Essential purpose. The limitations and exclusions of liability set out in Sections 9 and 10 apply to the maximum extent permitted by law and reflect a reasonable allocation of risk between you and EV Index given the public-interest, informational nature of the Site, which is provided at no direct charge to users and is supported by third-party advertising and affiliate commissions. They apply even if any remedy provided in these Terms fails of its essential purpose, and shall survive termination of these Terms or your access to the Site.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including under the Ontario Consumer Protection Act, 2002 and similar consumer-protection legislation. If you are a consumer, you have statutory rights that these Terms do not override.

11. Indemnification

You agree to defend, indemnify, and hold harmless EV Index, its operators, contractors, and affiliates from and against any third-party claims, demands, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your misuse of the Site; or (c) your violation of any law or the rights of any third party in connection with your use of the Site, in each case to the extent caused by, or resulting from, your acts or omissions. This obligation does not apply to the extent a claim results from our own negligence, wilful misconduct, or breach of these Terms. Your indemnification obligations under this Section are subject to all applicable consumer-protection legislation and shall not exceed what is reasonable in the circumstances.

12. Force majeure

EV Index will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, pandemics, acts of government, network or infrastructure outages, failures of third-party service providers, labour disruptions, or cyber-attacks. This Section operates without prejudice to, and does not expand the scope of liability beyond, the disclaimers in Section 9 and the limitations and exclusions in Section 10.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Subject to any non-waivable statutory rights — including, where applicable, the right of a consumer to bring proceedings in their home province under that province’s consumer-protection legislation, and Article 3149 of the Civil Code of Québecfor Québec residents — any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the courts of the Province of Ontario, and you consent to the jurisdiction of those courts.

Québec residents.If you reside in Québec, you have non-waivable rights under the Civil Code of Québec and the Québec Consumer Protection Act, and any provision of these Terms that conflicts with such rights is unenforceable against you to that extent. Where EV Index publishes a French-language version of these Terms, in the event of any inconsistency between the English and French versions, the version more favourable to the consumer prevails.

14. Severability

If any provision (or any part of a provision) of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision (or part) shall be severed or limited to the minimum extent necessary so that the remainder of the provision and the remaining provisions of these Terms continue in full force and effect. Where a provision is held unenforceable only against a particular class of users (for example, consumers in a specific jurisdiction), it shall remain enforceable against all other users to the maximum extent permitted by law.

15. Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and EV Index regarding the Site and supersede any prior or contemporaneous understandings. If these Terms and the Privacy Policy conflict, the Privacy Policy governs with respect to the handling of personal information; these Terms govern all other matters.

16. No waiver

Our failure to enforce any provision of these Terms on a particular occasion does not waive our right to enforce that provision, or any other provision, on any later occasion.

17. Changes, suspension, and termination

Changes to these Terms.We may update these Terms from time to time. For material changes that reduce your rights or expand your obligations, we will post a prominent notice on the Site for at least 30 days before the changes take effect. Non-material changes take effect on posting. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms. The “Last updated” date at the top of this page will always reflect the latest version.

Modification or discontinuation of the Site. We may modify, suspend, restrict, or discontinue the Site, any feature of the Site, or access to any data, page, or listing on the Site at any time and for any reason, with or without prior notice, and without liability to you or any third party.

Termination of access. We may terminate or suspend your access to the Site at any time, with or without notice, for any reason, including breach of these Terms. Upon termination, your right to use the Site immediately ceases.

Your right to stop using the Site. You may stop accessing or using the Site at any time, for any reason. If you have provided us with personal information, you may request access, correction, or deletion in accordance with our Privacy Policy.

Survival.Provisions of these Terms that by their nature should survive termination — including, without limitation, Sections 3 (Data Sources and Accuracy), 3A (Calculator Accuracy, Reliance, and Your Inputs), 5 (Corrections, Republication of Public Records, IP Complaints), 6 (Permitted Use, including the prohibitions on scraping, AI/ML extraction, and commercial reuse), 7 (Intellectual Property), 9 (Disclaimer of Warranties), 10 (Limitation of Liability, Class-Action Waiver, Essential Purpose, and Carve-outs), 11 (Indemnification), 13 (Governing Law and Jurisdiction), 14 (Severability), 18 (Notices), 19 (Assignment), and this Section 17 — shall survive any termination of your access to the Site.

18. Notices

Notices to EV Index under or in connection with these Terms must be in writing and sent to contact@evindex.ca; such notices are deemed received on the next business day after actual receipt at that address. Notices from EV Index to you sent by email to the address (if any) you have provided to us are deemed received when sent. Notices from EV Index to you posted on the Site are effective from the date of posting.

19. Assignment

EV Index may assign or transfer these Terms, in whole or in part, without your consent, to any successor or affiliate, including in connection with a merger, acquisition, reorganization, financing, or sale of all or substantially all of its assets or business. Where reasonably practicable, we will provide notice of any such assignment by posting on the Site or by email to the address (if any) you have provided to us. You may not assign or transfer these Terms or any of your rights or obligations under them without our prior written consent. Any attempted assignment in breach of this Section is void.
